The following is a summary of the Mosman Council Development Control Plan (DCP) 2012 which forms the legislation for the Preservation of Trees and Vegetation within Mosman through the Urban Forest Management Policy. This summary is to identify works that can be done without council approval and exempt tree species. This overview is only a guide. Please reference the complete Urban Forest Management Policy for more detailed information on council regulations and exemptions. Care should be also taken to check the property zoning and that the tree is not protected for Ecological or Heritage reasons which can also supersede the 10/50 Bushfire clearances laws.
Mosman Council Tree Preservation Order allows for the following removal or pruning works WITHOUT council permission. For all works outside of this scope, council approval in writing is required, unless the works fall under the 10/50 bush fire clearance legislation.
- Any tree less than 5m in height and less than 450mm CIRCUMFERENCE (300mm above ground) – excludes all tree ferns and any trees in heritage conservation areas or part of heritage item (exemption reduce to only 2m height).
- Dead wood in trees on private land.
- Pruning of trees for service wire clearances (500mm).
- Any tree listed as a weed for Mosman Council under the Biosecurity Act 2015 and any tree species listed as an exempt species under Mosman Council Urban Forest Management Policy (see table below) and Mosman Council DCP.

Council Approvals
Council approval in writing must be obtained prior to any works being carried out. Breaching a tree preservation order can result in very heavy fines.
